Terms & Conditions

1. Acceptance of the Terms

By creating an account, clicking “I Agree,” or using AI Writer Suite (“Service”), you (“User”) accept these Terms and enter into a legally binding agreement.

2. Definitions

“Content”: text generated or uploaded by the User.
“Subscription”: a paid, recurring license to access the Service.
“Billing Cycle”: the interval (monthly or annual) at which Subscription fees recur.

3. Account Registration

Users must be at least 16 years old and provide accurate information. Misuse (e.g., credential sharing or unlawful activity) may result in suspension.

4. Subscription, Billing & Payments

4.1 Auto‑Renewal – Subscriptions renew automatically at the end of each Billing Cycle unless cancelled before the renewal date.
4.2 Payment Processing – All payments are handled by a certified third‑party processor that meets PCI‑DSS Level 1 standards; we never store full card numbers.
4.3 Pricing Changes – We may revise fees with at least 14 days’ notice; continued use after the effective date constitutes acceptance.
4.4 Taxes – Prices are exclusive of taxes unless stated; users are responsible for any VAT/GST.
4.5 Chargebacks & Disputes – Initiating a chargeback without first contacting support may trigger a reasonable dispute‑handling fee.

5. Cancellation & Refunds

5.1 How to Cancel – Cancel anytime from the dashboard to avoid the next charge; access remains until the current term ends.
5.2 Refund Window – First‑time or renewal payments are refundable within 14 days, provided generated output has not exceeded fair‑use thresholds.
5.3 No Pro‑Rated Refunds After Window – After 14 days, fees are non‑refundable, including unused portions of a term.

6. Acceptable Use & Content Policy

6.1 Users must not upload or request content that is unlawful, discriminatory, defamatory, harassing, or infringing.
6.2 Prohibition on Human‑Face Generation – For security, ethical, and legal compliance, the Service blocks requests to create real or realistic human likenesses or deep‑fake content.
6.3 We reserve the right to monitor, flag, or remove content that violates these Terms.

7. Intellectual Property & License

7.1 Your Content – Subject to Section 6, you own and may commercialize Content you generate.
7.2 Our Technology – All Service code, templates, and models remain our exclusive property and are licensed, not sold, to you.

8. Data Security & Privacy

We follow industry best practices, including encryption in transit and at rest, regular vulnerability testing, and adherence to the twelve PCI‑DSS control groups.

9. Third‑Party Services

The Service may integrate with third‑party platforms (e.g., payment gateways). We are not liable for third‑party outages or actions.

10. Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non‑infringement.

11. Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim arising out of these Terms shall not exceed the amount paid by you to us in the 12 months preceding the event giving rise to liability, and we are not liable for indirect, incidental, or consequential damages.

12. Indemnification

You agree to indemnify and hold harmless the Service and its affiliates against claims arising from your violation of these Terms or misuse of the Service.

13. Suspension & Termination

We may suspend or terminate access for violations, non‑payment, or legal compliance reasons. No refunds are due for termination under this clause.

14. Governing Law & Dispute Resolution

Unless mandatory local law prevails, these Terms are governed by the laws of the jurisdiction where the Service operator is incorporated. Disputes shall be resolved by binding arbitration; class‑action waivers apply.

15. Changes to Terms

We may update these Terms by posting a revised version and notifying users via email or in‑app alert. Continued use after the effective date constitutes acceptance.
